Terms of Service
This service agreement is between No Hassle Hosting (hereinafter "NHH," "we," "our," or "us") and
you, our customer (hereinafter "client," "you" or "your").
By signing up for our services, you agree that you are the person legally responsible for all use of this account,
and that you are at least 18 years of age. If you are under 18 years of age, you need to have parental consent
in order to sign up, and the account must be ordered by a parent or guardian, in their own name.
You agree to supply NHH with a current and truthful name, postal address and telephone number
for our records, and you have a continued obligation to keep this information current.
You also agree that you are an authorized user of any credit card that you supply to us.
You agree that you have read and understand the Acceptable Use Policy.
Money Back Guarantee
Each plan includes a full 30-days money back guarantee. If you are not completely satisfied with
our services within 30 days, you will be given a full refund.
No refund is available after that period. This policy does not apply to any additional services
such as overages, maintenance fees, etc.
Accounts terminated for violating our Acceptable Use Policy
do not qualify for the 30-day money back guarantee. Only first-time accounts are eligible for a
refund. For example, if you've had an account with us before, cancelled and signed up again,
you will not be elegible for a refund. This is to protect our refund guarantee from being abused.
To receive a full refund, submit a support ticket.
Network Uptime Guarantee
We guarantee that the server and connectivity will be available at least 99.7% per calendar month,
excluding scheduled maintenance outages and upstream provider issues. If the monthly
outages exceed the maximum allowed .3%, we will credit 5% of the client's monthly fee per
additional 30 minutes of outages, up to 100% (one hundred percent) of the monthly fee at the end of the
No Hassle Hosting can ONLY be held responsible for its network and not for general conditions on the Internet.
Delays that occur outside NHH's routers caused by backbone failures/congestion, interruption of or delay in
transportation, unavailability of, interruption or delay in telecommunications or third party services
(including DNS propagation and your ISP) resulting in degradation of service and high packet loss or similar conditions,
cannot be guaranteed by NHH.
Price Freeze Guarantee
We guarantee that we will not raise the prices of your current plan for up to five years from the
date of account activation. The Price Freeze Guarantee excludes any and all overages associated with your
account. If you exceed the limits of your plan, you
will be asked to upgrade at your earliest convenience. The guarantee also excludes accounts that
are suspended or terminated due to
non-payment or violations of our Acceptable Use Policy.
All cancellation requests must be submitted to our online support desk by the person listed as
the authorized user. While there are no cancellation fees, you must cancel 48 hours prior to your
next billing cycle. Payments made up to your cancellation date are not refundable unless you are
cancelling within our 30-days money back guarantee period.
1. We reserve the right to cancel any account for violation of our Acceptable Use Policy without prior notice.
2. If you do not wish to continue hosting with us, it is your responsibility to cancel your account. Transferring a domain to a new hosting company does not constitute
canceling an account with No Hassle Hosting.
3. All cancellation requests must be submitted using the Support Desk.
You will need to indicate when you would like to cancel the account, as well as provide the domain name(s), username and password associated with your account to verify ownership.
4. Should you fail to adequately notify us of your intent to cancel an account, and the account is automatically
charged and renewed, we will only refund any charges placed on the account after the date the
official notification was received.
5. We do not give partial-month credits. For example, if you paid for a monthly plan on January 1, and cancel your
account on January 15th, you will not receive any credit for January. If you paid for the annual plan, you will only receive a
refund for the remaining FULL months in your plan. For example, if you paid for an annual plan on January 1, and cancel
your account on January 15th, you will not receive any credit for January; you will only receive credit for the remaining
11 full months.
You agree to supply appropriate payment for the services received from NHH, in advance of the
time period during which such services are provided. You agree that unless and until you
notify NHH, through the online support desk of your desire to cancel any or all services
received, those services will be billed on a recurring basis.
Accounts will not be activated or reactivated without prior payment.
All hosting fees are due on or before the due date of the renewing
account and/or domain name. Your due date is the same day of the month your account was originally activated. For example, if you sign up on March 15th, you would then be billed
every subsequent month on the 15th.
Failure to pay on the due date may result in an interruption of service
until the full amount is paid. We do not claim any responsibility for losses or expenses
experienced on an account due to non-payment.
Credit Card Payments
NHH accepts credit card payments using MasterCard, Visa, American Express. At the client's request,
payments can be arranged through PayPal recurring billing.
Although we do keep an eye on the expiration dates of credit cards we have on file for you and may send out reminders, you are
responsible for keeping your credit card information up to date. If there is any change in card type, number, or expiration date, please notify
us so that there will not be an interruption of service at the next billing date.
By taking out hosting services you are agreeing to a recurring payment plan.
Upon receipt of an invoice, unless you indicate that you would like to cancel the account or
stop the charges, the account will automatically be re-billed according to
the information contained within the invoice.
If we are unable to charge your credit card by the due date, you will immediately be notified and given
48 hours to supply an alternative payment method. If we do not receive a response and the card
is declined again in 48 hours, your account will be suspended for non-payment.
If an account has been suspended for non-payment, it will only be reactivated upon payment of
all overdue fees and a reactivation fee of $5.
After 30 days a suspended account will automatically be deleted from our system.
All copies of the web site files are permanently removed from our servers.
If we receive any notice from your credit card company that you are disputing a charge for your
account, or any notice that you have requested a refund for a charge, we will honor the request
and refund the fee. This refund will result in the account being overdue for payment,
which will result in the account being suspended. The suspended account will only be
reactivated once all disputed/refunded fees are re-charged as well as the administrative
fee to cover fees charged to us by our bank, resulting from your dispute.
NHH will give $5 per new customer sign up to customers participating in the No Hassle Hosting Affiliate Program.
Payments will only be received for those sign ups that can be tracked to the clients's unique affiliate code.
We are not
responsible for referrals that may not have had cookies enabled within their browser; since our Affiliate Program is
entirely cookie-based, it is our only method for verification purposes.
Referrals are not retro-active.
Credit will not
be given to affiliate for referrals who cancel their service within 30 days, to protect against abuse.

and paid out every 30 days.
Domain Name Registrations
Once a domain name has been registered, transferred, or renewed through NHH, no refunds will be given for the
domain registration or renewal fee.
You retain full ownership rights over any domain name registered or renewed through NHH.
We are not responsible for maintaining the registrant information for domain names. The domain owner can
modify all this information by logging in to Domain Management.
We are not liable for any domain disputes that may arise over changed registrant information for a domain name.
We are not responsible for renewing your domain for you. Domain registration and renewal fees are not included within any of our hosting packages.
The server will send out email reminders in 60 and 30 days from the domain expiration date; however, we are not responsible if you do not receive this
notification and your domain expires.
The server automatically performs nightly backups, and as a secondary precaution, we also
perform manual backups monthly. However, we recommend you also keep
regular backups of your site on your own local hard drive, because not all automated backups are 100% error-free.
No Hassle Hosting agrees that all personal information being voluntarily submitted to us in the processing of
your order (to be used for record and billing purposes), will be kept strictly confidential and used solely by
No Hassle Hosting, its authorized representatives and employees. We agree not to share, rent, sell or release
this information to any individual, entity or third party, for any reason, without the specific written
consent of the client; with exception as required by law, regulation or governmental authority.
Client gives NHH consent to contact client directly, via email or phone, regarding its services, for customer survey
feedback, general announcements or server status.
Limitations of Liability:
We cannot accept any liability for interruptions of service, loss of business,
breach of security or inadvertent access to your private data.
No Hassle Hosting makes
no warranties of any kind, expressed or implied for services we provide, including without limitation
any warranty or
merchantability or fitness for a particular purpose.
The maximum liability of NHH to client for damages relating to our failure to provide services shall be
limited to reimbursement of the total fees paid by client to NHH.
